		<description>I found this page by typing &#039;How does Jesus Diaz have a job?&#039; into google. 

Every time I read an article, I then start reading comments, and I see the same thing. The readers commenting, are pointing out the errors in every story, whether it be poor grammar, or &#039;facts&#039; which aren&#039;t really facts. THEN, this &#039;editor&#039; bans or removes the commenter! I bet he is a guy suffering from the tough guy syndrome in real life. Just a hot head who cannot take criticism in anyway. I rarely go back to the sight now. Such a shame.</description>

		<description>IMO, the biggest problem with the patent litigation system as it currently stands is that the process cannot weigh the comparative value of claims. If you look at the Samsung litigation timeline, Apple filed 16 claims first and many of these claims were specific to Samsung&#039;s slavish copying of everything from icons to the way Samsung&#039;s products were packaged. But since Samsung (and every CE company of any scale) has patents, Samsung countersued based on far more generic patents that could apply to &lt;em&gt;any&lt;/em&gt; telecommunication device, such as &quot;Method and Apparatus for Data Transmission in a Mobile Telecommunication System Supporting Enhanced Uplink Service&quot;. These claims are not responsive to Apple&#039;s, but value is irrelevant to their use as a negotiating tool. If someone commits a felony (such as stealing your car or murdering your wife), you call the police and they take it from there. However, if someone steals your intellectual property, there is no patent police, no copyright police, no trademark police. You have to sue to bring it before a judge. If you don&#039;t defend your intellectual property, you lose it.

Apple isn&#039;t being particularly litigious. Others are being particularly larcenous. Apple is taking the only course of action that is possible.</description>

If you&#039;re going to compare phones by any reasonable criteria, I believe that finishing a given task in under 10 seconds would be enough. However they chose to split hairs and count milliseconds there. And that really is nonsense AND brings bad publicity. If I were Microsoft, I&#039;d have rerouted some portion of the millions of $$$ Microsoft puts into marketing into the prize fund, and have given away tens if not hundreds of laptops and Windows Phones. That would maybe be received as bribing the customers, but it sure would have generated a lot of publicity, and that would have been good publicity.</description>
